Virginia Retirement System (VRS) Disability
If you are an employee of the Commonwealth of Virginia or a local government agency in Virginia, you may be entitled to Virginia Retirement System (VRS) disability benefits if you are no longer able to work for medical reasons. School system employees like teachers, maintenance workers or support staff can apply as well as many city, county or town employees across Virginia. Check with your HR department to see if you are an eligible employee.
If you qualify for VRS disability, you may be able to receive benefits that would allow you to basically retire on VRS disability, even if you haven’t reached retirement age.
VRS Disability Claim Basics
- You may file for VRS disability benefits through your employer for any physical or mental health impairments which prevent you from performing your job. However, VRS disability claims require medical proof that your qualifying medical condition(s) permanently keep from working your specific job.
- Your application is sent to an independent medical board to make a recommendation on the disability claim.
- If your application is denied, you may appeal with additional information and evidence.
- After the second denial, the claim is then appealed to a VRS lawyer who acts as an independent fact finder, an evidentiary hearing is held, and another medical board decision is made.
- If denied an appeal of the final VRS decision can be made to a Circuit Court in Virginia.
Why hire a lawyer to help with your VRS disability claim?
The most critical element of proof for all VRS disability claims is that you must prove that your disabling medical conditions permanently prevent you from performing your job. The “permanency” requirement is critical to your claim because a temporary condition or a medical problem that is responsive to treatment may not qualify you for VRS disability benefits.
VRS claims often have fast deadlines, confusing regulations, and the VRS puts the burden of proof on YOU to win your case! VRS doctors and staff work for VRS not for you. Don’t go it alone! The process can be overwhelming for claimants who are out of work and also dealing with serious, chronic medical problems.
